A concern we often hear when people talk about their future is the possibility of entering long-term care when they are older. We would all prefer to live out our lives from the comfort of our homes, but sadly, this isn't always possible. A decline in health or lack of capacity may force the difficult decision to move into long-term care. 

Someone entering long-term care can be a distressing time for all involved. There are many crucial decisions to make, including what care home to choose, how the care will be paid for, and what happens to their assets and personal possessions. There may also be decisions over legal aspects, such as Wills, Lasting Power of Attorneys, or Court of Protection. 

Disputes can also emerge when the Local Authority carries out its assessment of needs and financial assessments. Financial assessments can heavily impact how someone's care is funded and can be the difference from paying as little as £500 a month to £5,000. 

The Local Authority may challenge a gift from the past or consider how assets are assessed and whether they should be disregarded or not. They will also evaluate what income is included in the person's contribution for care. However, sometimes mistakes can be made, which could be very costly.

Care Home Contracts can be another daunting aspect of long-term care. The document is a legally binding agreement between the person paying the fees and the care provider. It states the level of care the person will receive and the costs involved. It also includes other important information, such as cancellation policies, complaint policies and notice periods. So, it is always best to check the terms of the agreement before signing.
